These Terms of Service ("Terms") govern your access to and use of the Ishh website, online store, products, services, content, features, checkout, customer account features, promotions, and other online services operated by Ishh ("Ishh," "we," "us," or "our").

Ishh is an Ontario, Canada-based online women’s clothing brand. We currently sell and ship within Canada, excluding Quebec. We do not operate a physical retail store, showroom, pickup location, or in-person return location unless we expressly state otherwise in writing. We do not currently sell or ship products to Quebec, the United States, or other jurisdictions outside Canada. If we begin selling or shipping to Quebec, the United States, or other jurisdictions in the future, we may update these Terms and add jurisdiction-specific notices before or at the time those sales begin.

By accessing our website, creating an account, placing an order, participating in a promotion, submitting content, or otherwise using our online store, you agree to these Terms and to any other policies referenced in these Terms, including our Privacy Policy, Shipping Policy, Returns and Exchanges Policy, Cookie Notice, and any product-specific, promotion-specific, or checkout terms posted on our website.

If you do not agree to these Terms, you must not use our website or place an order.

These Terms do not limit any rights you may have under applicable consumer protection, privacy, or other laws that cannot legally be limited or waived.

Ishh operates as an online ecommerce brand only. We do not operate a physical storefront, showroom, pickup location, or in-person return location unless we expressly state otherwise in writing.

 

 

2. Eligibility and Use of the Website

You may use our website and place orders only if you are legally able to enter into a binding contract in your province or territory of residence.

By using our website or placing an order, you represent that:

  • You are at least the age of majority in your province or territory, or you are using the website with the involvement and consent of a parent or legal guardian.

  • The information you provide to us is accurate, current, and complete.

  • You will use our website and products only for lawful personal, household, or permitted business purposes.

  • You will not misuse the website, interfere with its operation, attempt unauthorized access, or use it for fraudulent, harmful, misleading, or unlawful activity.

We may refuse service, cancel orders, suspend accounts, or restrict access to our website if we believe these Terms have been violated, an order appears fraudulent, payment cannot be verified, or doing so is necessary to protect Ishh, customers, service providers, or others.

 

 

3. Online Store Platform

Our online store is hosted on Shopify. Shopify provides the ecommerce platform that allows us to sell products and services to you.

Your use of Shopify-powered checkout, payment features, account features, Shop Pay, or other Shopify services may also be subject to Shopify’s own terms, policies, and privacy practices. Ishh is not responsible for the acts, omissions, platforms, systems, policies, or services of Shopify or other third-party providers, except to the extent required by applicable law.

 

 

4. Products, Descriptions, Availability, and Fit

Ishh sells women’s clothing and related fashion products online.

We try to display product names, descriptions, colours, sizing, measurements, materials, prices, care instructions, and availability as accurately as reasonably possible. However:

  • Colours may appear differently depending on your screen, lighting, display settings, photography, and device.

  • Sizing, fit, drape, length, and appearance may vary by body type, styling, garment construction, fabric, and measurement method.

  • Handmade, small-batch, embroidered, embellished, printed, dyed, or specialty garments may have natural variations.

  • Product images may include styling items, accessories, jewellery, footwear, or props that are not included unless expressly stated on the product page.

  • Minor differences in colour, texture, finish, placement of print, embellishment, or stitching are not necessarily defects.

We may change, discontinue, limit, or update products at any time without notice. Product availability is not guaranteed until your order is accepted and confirmed by us.

We reserve the right to limit quantities, reject orders, cancel orders, or discontinue products where necessary, including where inventory is unavailable, a listing error occurs, payment cannot be verified, fraud is suspected, shipping is unavailable, or we are legally unable to complete the order.

 

 

5. Pricing, Taxes, Discounts, and Promotions

All prices are listed in Canadian dollars unless stated otherwise.

Prices, product availability, discounts, promotions, and shipping rates may change without notice. The price charged for a product will be the price displayed at checkout at the time you submit your order, subject to correction of errors as described in these Terms.

Applicable taxes, shipping fees, and any other charges will be disclosed during checkout before you submit your order. We aim to avoid hidden mandatory fees. If a charge is mandatory and not imposed by law, we will not intentionally advertise a product price that cannot be obtained because of that charge.

Discounts, promotional codes, scratch-card offers, reveal-style offers, first-order offers, newsletter sign-up offers, loyalty offers, referral offers, and other promotions are subject to the specific terms provided with the promotion and the following general rules unless we state otherwise:

  • Promotions may be changed, suspended, or ended at any time, subject to applicable law.

  • Promotions may be limited to eligible customers, products, collections, order values, dates, or channels.

  • Promotional codes may be limited to one use per customer, one use per order, one use per household, one use per device, or one use per email address.

  • Promotions generally cannot be combined unless expressly stated.

  • Promotions have no cash value and cannot be redeemed for cash.

  • Promotions may not apply to taxes, shipping, gift cards, prior purchases, or excluded products unless stated.

  • We may cancel or refuse promotional benefits if we believe there is fraud, abuse, technical error, misuse, duplicate account creation, unauthorized resale activity, or violation of promotion terms.

Scratch-card, reveal, spin-to-win, first-order, newsletter, or similar promotional offers are promotional discounts only and do not involve paid participation, cash prizes, gambling, lottery, or chance-based purchase requirements. No purchase is required to sign up for marketing unless expressly stated, and customers may unsubscribe from marketing at any time.

If we advertise a discount, sale, comparison price, regular price, or savings claim, we intend for that claim to be truthful and based on a genuine reference price or lawful basis. If a pricing or discount error occurs, we reserve the right to correct the error, cancel affected orders, or contact you for instructions, subject to applicable law.

 

 

6. Orders and Checkout

When you place an order through our website, you are making an offer to purchase the selected products under these Terms and any policies referenced at checkout.

Before submitting your order, checkout will provide you with an opportunity to review your order details, including the products selected, quantities, shipping address, billing information, shipping method, applicable taxes, shipping fees, discounts, and total price. You are responsible for reviewing and correcting any errors before submitting your order.

Before placing an order, you may be required to confirm that you have reviewed and agree to these Terms, our Privacy Policy, Shipping Policy, Returns and Exchanges Policy, and any product-specific, promotion-specific, final sale, or checkout terms. Your order is not complete until you submit it through checkout and receive confirmation that the order has been received.

Our policies may be linked or displayed during checkout, in the website footer, on product pages, in order confirmations, or in other customer communications. You are responsible for reviewing the applicable policies before placing an order.

After you submit your order, you may receive an order confirmation email. An order confirmation means we have received your order. It does not necessarily mean that we have accepted your order or guaranteed inventory.

We may accept, decline, cancel, or limit your order for reasons including:

  • Product unavailability.

  • Incorrect product, pricing, tax, discount, or shipping information.

  • Payment failure, payment reversal, chargeback risk, or inability to verify payment.

  • Suspected fraud, abuse, unauthorized activity, promotion abuse, reseller activity, or violation of these Terms.

  • Shipping restrictions, including orders to Quebec or jurisdictions we do not serve.

  • Errors in product listings, checkout, inventory, or system processing.

  • Legal, regulatory, operational, or safety concerns.

If we cancel an order after payment has been taken, we will issue a refund to the original payment method, subject to payment processor timelines and applicable law.

 

 

7. Order Verification and Fraud Prevention

We may use automated and manual tools to screen orders for fraud, abuse, unauthorized activity, payment risk, shipping risk, promotion abuse, chargeback risk, reseller activity, or violation of these Terms.

To help protect against fraud, unauthorized transactions, and chargebacks, Ishh may require additional verification before accepting or shipping an order. This may include confirming billing information, shipping information, identity, payment authorization, email address, phone number, or other order details.

We may contact you to verify order details before accepting or shipping an order. If we cannot verify the order, or if we believe the order presents a risk to Ishh, our customers, our payment providers, our shipping providers, or others, we may delay, cancel, refund, or refuse the order.

We are not responsible for delays caused by fraud screening, payment review, verification requests, risk controls, or payment provider review, except where required by applicable law.

 

 

8. Payment

We may accept payment through payment processors, payment services, card networks, and payment methods such as Stripe, PayPal, Apple Pay, Visa, Mastercard, American Express, and other methods displayed at checkout.

By submitting payment information, you represent and warrant that:

  • You are authorized to use the selected payment method.

  • The payment information you provide is accurate and complete.

  • You authorize us and our payment providers to charge the total amount shown at checkout, including applicable taxes, shipping fees, and other disclosed charges.

Payment processing is handled by third-party payment providers. Ishh does not intend to store full payment card numbers on our own systems. Payment providers may collect, process, store, and verify payment information according to their own terms, privacy policies, security practices, and legal obligations.

We are not responsible for payment provider delays, outages, declines, holds, security reviews, currency conversion fees, bank fees, card issuer fees, or other third-party payment issues, except to the extent required by applicable law.

 

 

9. Chargebacks and Payment Disputes

If you have an issue with an order, you agree to contact Ishh first at shopishh31@gmail.com so we can try to resolve the issue.

If you initiate a chargeback, payment dispute, bank dispute, payment reversal, or similar claim, we reserve the right to respond through the applicable payment processor, card network, bank, or dispute administrator. We may provide relevant information and evidence, including order details, checkout records, payment records, delivery records, tracking information, customer communications, account information, fraud screening information, policy acknowledgements, and other information related to the transaction.

Filing a chargeback or payment dispute does not automatically cancel your order, return obligations, or responsibility for amounts lawfully owed. If a chargeback is resolved in Ishh’s favour, or if we determine that a dispute was fraudulent, abusive, or inconsistent with these Terms, we may refuse future orders, suspend or close your account, cancel promotional benefits, reject future promotional use, or take other steps permitted by law.

Nothing in this section limits any rights you may have under applicable consumer protection laws, payment network rules, or card issuer rules.

 

 

10. Shipping, Delivery, and Risk of Loss

Ishh currently ships within Canada, excluding Quebec. We do not currently ship to Quebec, the United States, or other jurisdictions outside Canada.

Shipping options, costs, delivery estimates, and service areas will be shown at checkout or in our Shipping Policy where available. Delivery timelines are estimates only and are not guaranteed unless we expressly state otherwise in writing.

Delivery may be affected by circumstances outside our control, including carrier delays, weather, labour disruptions, holidays, customs or border issues if applicable in the future, incorrect shipping information, payment reviews, fraud reviews, inventory delays, technical issues, or force majeure events.

You are responsible for providing a complete, accurate, secure, and deliverable shipping address. Ishh is not responsible for delays, misdelivery, failed delivery, loss, theft, or additional costs caused by incorrect, incomplete, outdated, unsafe, inaccessible, or undeliverable shipping information provided by you, except where required by applicable law.

If an order is returned to us because of an address issue, failed delivery, refusal, non-collection, or inability to deliver, we may charge additional shipping fees to reship the order or deduct applicable shipping and handling costs from any refund, subject to applicable law.

Ishh may choose the shipping method and may require tracking, delivery confirmation, signature confirmation, address verification, identity verification, payment verification, or other delivery safeguards for certain orders, including high-value orders, first-time orders, orders flagged as higher risk, orders using promotional discounts, or orders where billing and shipping information do not match.

Title and risk of loss for products pass to you when the products are delivered to the shipping address provided, except where applicable law requires otherwise. If tracking shows that an order was delivered to the shipping address provided at checkout, Ishh may treat the order as delivered.

If a package is marked as delivered but you have not received it, contact us promptly at shopishh31@gmail.com. We will reasonably assist with carrier inquiries where appropriate, but we are not responsible for theft, loss, misdelivery, or failed delivery caused by incorrect address information, unsafe delivery locations, carrier error, or circumstances outside our control, except where required by applicable law.

 

 

11. Quebec Shipping Restriction

Ishh does not currently sell or ship products to Quebec. We also do not currently target Quebec customers for online sales.

If our website, advertisements, social media content, or third-party platforms are accessible from Quebec, that does not mean Ishh is offering products for sale or shipment to Quebec.

If a Quebec shipping address is submitted, we may reject, block, or cancel the order and refund any payment received, subject to payment processor timelines and applicable law.

If Ishh begins selling or shipping to Quebec in the future, we will review and update our website, customer-facing policies, privacy notices, language practices, checkout, customer communications, and other processes as required by applicable Quebec law.

 

 

12. Returns, Exchanges, Refunds, and Store Credit

Returns, exchanges, refunds, and store credits are governed by our Returns and Exchanges Policy as posted on our website at the time of purchase.

Unless required by applicable law or stated in our Returns and Exchanges Policy:

  • Products must be returned within the applicable return window stated in our Returns and Exchanges Policy.

  • Products must be unworn, unused, unwashed, undamaged, unaltered, fragrance-free, stain-free, and returned with original tags, packaging, and proof of purchase.

  • Certain products may be final sale, including sale items, discounted items, promotional items, customized items, personalized items, intimate items, accessories, gift cards, or other products marked final sale.

  • Products marked final sale are not eligible for return, exchange, refund, or store credit except where required by law or where we confirm that the product was defective, damaged before delivery, or incorrect due to our error.

  • Shipping charges may be non-refundable.

  • Return shipping costs may be the customer’s responsibility unless the return is due to our confirmed error or a confirmed defective product.

  • Refunds may be issued to the original payment method, store credit, or another method stated in our Returns and Exchanges Policy.

  • Refund timing may depend on payment processor, card issuer, bank, or platform processing timelines.

Return eligibility may be denied if a product is returned late, worn, washed, altered, damaged, stained, scented, missing tags, missing packaging, missing proof of purchase, or otherwise not in the required condition.

Our return and final sale terms may be displayed on product pages, during checkout, in the website footer, in our Returns and Exchanges Policy, or in order confirmation communications. You are responsible for reviewing return eligibility before placing your order.

Nothing in these Terms or our Returns and Exchanges Policy limits any non-waivable rights you may have under applicable consumer protection laws.

 

 

13. Damaged, Defective, or Incorrect Products

You must inspect your order promptly after delivery. If you believe a product is damaged, defective, or incorrect, you must contact us within 72 hours of delivery at shopishh31@gmail.com with your order number, a description of the issue, and clear photos of the product, packaging, tags, and shipping materials where applicable.

This reporting window does not limit any rights you may have under applicable law, but it helps us review the issue, preserve evidence, and work with shipping providers or suppliers where appropriate.

We may request reasonable information, photos, return of the product, or other evidence to assess the issue. If we confirm that a product is defective, damaged before delivery, or incorrect due to our error, we may offer a replacement, exchange, repair, refund, or store credit, depending on the circumstances, product availability, our policies, and applicable law.

Normal variations in colour, fabric, stitching, embellishment, print placement, texture, handmade details, sizing perception, or fit preference are not necessarily defects.

Damage caused by wear, washing, drying, ironing, steaming, cleaning, alteration, misuse, improper care, fragrance, cosmetics, deodorant, staining, storage, or third-party cleaning services is not considered a product defect unless required by applicable law.

 

 

14. Product Care and Use

You are responsible for following all product care instructions, labels, and recommendations provided with the product or on our website.

Ishh is not responsible for damage caused by improper washing, drying, ironing, steaming, cleaning, storage, alteration, wear, misuse, neglect, exposure to chemicals, fragrance, cosmetics, deodorant, heat, sunlight, moisture, or third-party cleaning services, except where required by applicable law.

 

 

15. No Unauthorized Resale

Products purchased from Ishh are intended for personal use only and may not be purchased for unauthorized resale, marketplace resale, commercial redistribution, or export.

We may limit quantities, reject orders, cancel orders, suspend accounts, or refuse future orders that appear to involve unauthorized resale, reseller activity, suspicious purchasing patterns, duplicate accounts, export activity, chargeback abuse, refund abuse, or abuse of promotions.

 

 

16. Customer Accounts

You may have the option to create a customer account. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

You agree to provide accurate, current, and complete account information and to update it when necessary. We may suspend, restrict, or terminate your account if we believe it has been misused, compromised, used fraudulently, or used in violation of these Terms.

17. Email, SMS, and Marketing Communications

If you sign up for newsletters, SMS messages, product launch updates, promotional offers, restock alerts, abandoned cart reminders, or similar communications, you agree to receive those communications from Ishh, subject to applicable law.

We will comply with Canada’s Anti-Spam Legislation where applicable, including consent, identification, and unsubscribe requirements for commercial electronic messages.

You may unsubscribe from marketing emails by using the unsubscribe link in our emails. You may unsubscribe from SMS marketing, where offered, by following the instructions in the message, such as replying STOP, where available.

Even if you unsubscribe from marketing, we may still send transactional or service-related communications, such as order confirmations, shipping updates, return updates, refund notices, account notices, security notices, policy updates, or legally required communications.

By using our website, creating an account, placing an order, signing up for marketing, contacting us, participating in promotions, or otherwise interacting with Ishh, you acknowledge that your personal information will be handled in accordance with our Privacy Policy and applicable law.

 

 

19. User Content, Reviews, Photos, and Social Media

You may have the opportunity to submit or share reviews, photos, testimonials, comments, social media posts, tags, handles, feedback, survey responses, or other content related to Ishh or our products ("User Content").

By submitting, tagging, posting, or otherwise making User Content available to Ishh, you represent and warrant that:

  • You own or have the necessary rights and permissions to submit the User Content.

  • The User Content is accurate, lawful, and not misleading.

  • The User Content does not infringe the rights of any third party.

  • The User Content does not contain unlawful, abusive, defamatory, obscene, discriminatory, harassing, hateful, fraudulent, or harmful material.

  • The User Content does not contain personal information of another person without their consent.

To the fullest extent permitted by law, you grant Ishh a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to use, reproduce, display, publish, edit, adapt, distribute, and create derivative works from User Content for marketing, advertising, website, social media, product, customer service, and business purposes.

If we want to use identifiable customer photos, videos, or testimonials in paid advertising or other prominent marketing campaigns, we may request additional permission where appropriate or required by law.

We may moderate, edit, refuse, remove, or stop using User Content at any time, but we are not required to do so. We are not responsible for User Content posted by customers or third parties, except to the extent required by applicable law.

If you want us to stop using specific User Content that you submitted, contact us at shopishh31@gmail.com. We will review your request and respond reasonably, subject to legal, technical, operational, and archival limitations.

 

 

20. Intellectual Property

The website and its content, including text, images, photographs, graphics, logos, product names, collection names, designs, videos, audio, layout, icons, software, code, look and feel, trademarks, trade names, and other materials, are owned by or licensed to Ishh and are protected by intellectual property and other laws.

You may use our website for personal, non-commercial shopping purposes only. You may not copy, reproduce, modify, distribute, sell, license, scrape, extract, reverse engineer, publicly display, exploit, or use any part of our website or content without our prior written consent, except as permitted by applicable law.

Nothing in these Terms grants you any ownership rights in Ishh’s intellectual property.

If we cancel an order after payment has been taken, we will issue a refund to the original payment method, subject to payment processor timelines and applicable law.

We may update, modify, suspend, discontinue, or restrict access to all or part of the website at any time without notice, subject to applicable law.

We do not guarantee that the website will be uninterrupted, secure, error-free, accurate, complete, compatible with all devices, or available at all times.

To the fullest extent permitted by law, the website, content, products, services, and third-party services are provided on an "as is" and "as available" basis, without warranties, representations, or conditions of any kind, whether express, implied, statutory, or otherwise.

To the fullest extent permitted by law, Ishh disclaims all warranties, representations, and conditions, including implied warranties or conditions of merchantability, fitness for a particular purpose, durability, title, non-infringement, accuracy, availability, and uninterrupted operation.

Nothing in these Terms excludes or limits any warranty, condition, representation, or consumer protection that cannot legally be excluded or limited under applicable law.

 

 

26. Limitation of Liability

To the fullest extent permitted by law, Ishh and its owners, directors, officers, employees, contractors, agents, service providers, suppliers, licensors, and affiliates will not be liable for any indirect, incidental, consequential, special, exemplary, punitive, or similar damages, including loss of profits, loss of revenue, loss of data, loss of goodwill, business interruption, or other intangible losses arising out of or related to your use of the website, products, services, content, third-party services, or these Terms.

To the fullest extent permitted by law, Ishh’s total liability for any claim arising out of or related to these Terms, the website, products, services, or your order will not exceed the amount you paid to Ishh for the product or order giving rise to the claim.

Some jurisdictions do not allow certain exclusions or limitations of liability, so some of the above limitations may not apply to you.

Nothing in these Terms limits liability for fraud, intentional misconduct, gross negligence, personal injury, death, or any liability that cannot legally be limited or excluded under applicable law.

 

 

27. Indemnification

To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless Ishh and its owners, directors, officers, employees, contractors, agents, service providers, suppliers, licensors, and affiliates from and against any claims, demands, losses, liabilities, damages, judgments, penalties, fines, costs, and expenses, including reasonable legal fees, arising out of or related to:

  • Your breach of these Terms.

  • Your misuse of the website, products, services, or content.

  • Your User Content.

  • Fraud, chargeback abuse, promotion abuse, return abuse, unauthorized transactions, or false information provided by you.

Ishh will not be responsible for delays, failures, losses, or damages caused by events beyond our reasonable control, including weather, fire, flood, pandemic, public health emergency, labour disruption, carrier delay, supply chain disruption, customs or border delay if applicable in the future, government action, war, terrorism, civil unrest, power outage, internet outage, cybersecurity incident, platform outage, payment processor outage, Shopify outage, or other circumstances beyond our reasonable control.

 

 

29. Governing Law and Disputes

Subject to any mandatory consumer protection rights that may apply in your province or territory, these Terms and any dispute arising out of or related to these Terms, the website, products, services, or orders are governed by the laws of the Province of Ontario and the applicable federal laws of Canada, without regard to conflict of law principles.

Subject to any mandatory consumer protection rights that may apply in your province or territory, you agree that disputes will be resolved by the courts located in Ontario, Canada.

Nothing in this section limits any non-waivable rights you may have under applicable consumer protection laws.
